Google has filed a motion to separate it from the lawsuit between Apple and Epic. The company insists on the fundamental difference between the removal of Fortnite from the App Store and Google Play.On September 3, Google filed documents with the U.S. District Court.
In particular, the company appealed to Judge Yvonne Gonzalez Rogers, who is leading the Epic case against Apple and offered to combine the two processes.
Google believes that such a decision would entail “a small risk of conflicting results.” This may be due, among other things, to the difference in the policies of the two companies.
“Despite the fact that Android and iOS compete to attract application developers and end users, Google and Apple use different business models, agreements and rules to support competing ecosystems,” the petition says.
The key difference, according to Google, is that Apple allows applications to be distributed only through the App Store, while on Android users can install third-party stores or download programs directly via the Internet. That is why the removal of Fortnite from Google Play does not prevent Epic Games from accessing the site as a whole.
Google also notes that none of its divisions has yet received official complaints to its address. The company intends to confront Epic “largely based on circumstances unique to Android” only after the Fortnite developers submit the necessary documents and the court sets a start date for the process.
In August, Epic Games introduced a payment system to the mobile version of its battle royale, bypassing the rules of the App Store and Google Play. This led to the removal of the game from the official stores and the beginning of a large-scale conflict.
Previously, the court banned Apple from deleting the Epic Games account associated with Unreal Engine. At the moment, Fortnite is not available for download in the App Store, and iOS users have lost the new season and upcoming updates. As a result, since September 2, the DAU of the game has fallen by 60%.
