Last Friday, Epic Games sent a new petition regarding Apple to the court. In it, the company challenges the decision of the “apple” company to remove Fortnite from the App Store during the proceedings.
The publisher asks:
- prohibit Apple from deleting and blocking Fortnite (and updates to it) due to the fact that the publisher has implemented direct payments in order not to pay 30% of Apple’s share;
- prevent Apple from taking any action against Epic Games (for example, deleting the developer account);
- prevent Apple from disabling or changing the Fortnite code in the iOS version;
- return the developer account from which Fortnite was published in the App Store.
The reasons for this from the point of view of Epic Games are the following things:
- she, they say, will probably win the court;
- suffers from irreparable damage;
- the public interest is in favor of a ban.
Speaking about the damage, Epic Games admits that since September 2, the DAU of the game on iOS has fallen by 60%. And the company is afraid that it may lose its entire audience on this platform, since 63% of all iOS players entered the game only from Apple mobile devices.
According to the publisher, this hits the entire ecosystem built around Fortnite. In its appeal to the court, Epic Games states: the value of its game is built in a vast community. And if millions of people are isolated from the game overnight, the project immediately becomes less attractive in the eyes of users.
How the court will react to the new Epic Store petition will become clear on September 28, when the hearing on the preliminary injunction will take place. Before that, most likely, the parties will exchange statements several more times.
