Division Mail.ru Group, which develops and operates games, filed a lawsuit against the Federal Tax Service, insisting that income from micropayments should not be subject to VAT, – reports RBC.

According to lawyers Mail.ru , according to the Tax Code of the Russian Federation, paid use of software products on the basis of a license agreement should not be subject to VAT.

In other words, when a company sells paid digital products, it does not pay VAT in Russia. But for some reason it pays money from shareware games. In Mail.ru we decided to stop this practice, appealing to the fact that for micropayments, users have access to an expanded version of the game. And opening access to it is not fundamentally different from using the paid version.

If the Moscow Arbitration Court recognizes the claims Mail.ru fair, the company will not pay to the state treasury 18% of the earned for the first quarter of 2013 (it was during this period that a lawsuit was filed) on online games 1.5 billion rubles.  And, perhaps, he will no longer pay them at all.
