Electronic Arts has been accused of using dynamic complexity technology in its three major sports franchises since 2017. The class action lawsuit against the company states that in this way users are forced to buy loot boxes. The lawsuit was filed in the District Court of Northern California, the newspaper reports Gamesindustry.biz .
It is alleged that the company’s actions violate the law on consumer protection, as well as the laws on false advertising and unfair competition.
Dynamic Difficulty Adjustment (DDA) technology has been patented by EA and aims to increase player retention and engagement. The behavior of artificial intelligence in matches adapts to users, not letting them get bored or disappointed by frequent losses.
Previously, EA denied the presence of this technology in FIFA, Madden NFL and NHL. However, the plaintiffs believe that the company uses DDA in secret from the players and forces them to buy loot boxes, since this system sometimes specifically underestimates the characteristics of even top virtual athletes.
“We believe that these statements are unfounded and expose our games in a false light,” EA representatives said, noting that they will defend their position in court.
In October, the company was sued in Canada, accusing it of using loot boxes. EA also intends to appeal the decision of the Dutch authorities, according to which the company faces a fine of up to € 10 million.
