The Seattle court rejected the lawsuit of the South Korean publisher Nexon, filed against the Ironmace studio in April 2023. The company accused the developers of the PvPvE action Dark and Darker of stealing the code and assets of the unreleased P3 shooter.

Judge Tana Lin found Nexon’s arguments untenable. She said that the company did not provide convincing evidence of copyright infringement.

Lin’s decision also notes that companies should conduct legal proceedings not in the United States, but in South Korea, since both Nexon and Ironmace are registered there. In addition, most of the evidence is written in Korean, and many witnesses are located in South Korea. Recall that Nexon appealed to the American court due to the fact that, in her opinion, the developers of Dark and Darker are actively promoting the game in the States.

Nexon and Ironmace are already suing in South Korea. Earlier, both companies filed lawsuits in Suwon City Court.
