Nintendo requested the court to dismiss a lawsuit filed by American gamers in the spring. The lawsuit accused the company of attempting to "unjustly enrich" itself from additional tariffs imposed by U.S. President Donald Trump in 2025.
The gamers claimed that Nintendo recouped its tariff expenses twice: first by raising console prices, and then, after the new customs tariffs were revoked, by seeking a reimbursement from the U.S. authorities for the overpayments. According to the plaintiffs, Nintendo should have refunded the buyers as well, but the company did not do so.
In its motion to the court, Nintendo stated that it did not violate any laws. The company emphasized that the gamers voluntarily agreed to purchase consoles at higher prices, and thus "received exactly what they anticipated and paid for."
The company highlighted that this is how commercial transactions operate, therefore, there is no basis for compensation.
"Plaintiffs are not entitled to a refund simply because there were changes in tariff legislation after [their purchase]," Nintendo added.
Previously, Sony received a similar lawsuit. The company has not publicly discussed the complaint.
